In an order filed in Wyoming, US District Judge Scott Skavdahl said outgoing Secretary of the Interior Sally Jewell had the authority to issue the rule under the US Mineral Leasing Act.
“This court cannot conclude the rule enacted exceeds the secretary’s authority or is arbitrary and capricious,” Skavdahl decided. “Petitioners have not established their right to relief is clear and unequivocal.”
