Norway’s EMGS has dropped its proceedings against British rival OHM over alleged infringement of, and threats to, a patent covering one aspect of its seabed logging technology.
As part of this agreement OHM has undertaken not to infringe the patent while EMGS has agreed to pay £50,000 (about $95,000) in defence costs to OHM.
However, the Norwegian company said the agreement does not limit its ability to defend any of its patents against infringement by OHM.
"We are very satisfied with OHM agreeing not to infringe our patent," said Terje Eidesmo, EMGS’ chief executive.
“We have not been presented with any data to refute our belief that they had infringed our patent and we continue to believe that they did. We will vigorously enforce our patents in the future," he stressed.
OHM said it had filed evidence with the UK courts seeking to demonstrate that EMGS “was mistaken in its belief that OHM’s activities were infringing”.
Dave Pratt, OHM’s boss, said: “We have consistently stated that we were not infringing the patent in question. We are very pleased that EMGS has dropped this time-consuming action. We will now continue with our business as normal."
