The factual information is, to the best of our knowledge, correct but the way it is presented gives the impression that Bergesen ended up as the sole tender exclusively because it was the only contractor able to meet the specifications. This is not the case.
Single Buoy Moorings (SBM) and Modec, and probably several other contractors, would have been able to find the right vessel and meet the specifications, but the reason that SBM has not made the effort lies in the fact that the contract conditions imposed by Pemex expose the contractor to liabilities far in excess of our acceptable levels, particularly in respect of consequential damages and pollution.
